Join us as the Hon. Joanne F. Alper (Ret.) and the Hon. James Clark (Ret.) discuss the ethical Rules, principles, and practices involved as lawyers negotiate in mediation as well as in the other areas of their practices. Drawing from the Virginia Rules of Professional Conduct and the ABA Model Rules, the topics addressed will include competence, honesty, the role of the client in making decisions, communicating with the client, communicating with those affiliated with opposing parties, and threats of criminal sanctions to gain leverage. Hypotheticals will be used to illustrate.

Hon. Joanne F. Alper (Ret.) 
Retired Judge
Arlington Circuit Court

The Honorable Joanne F. Alper (Ret.) began her accomplished legal career with a broad civil litigation practice including a focus on family law. Her leadership within the bar was highlighted by service as President of the Arlington County Bar Association and as Chairman of the Family Law Section of the Virginia State Bar.  Later, she was appointed to the Juvenile & Domestic Relations District Court where she ascended to Chief Judge before being appointed to the Circuit Court.  She served that court with distinction for fourteen years adjudicating many complex commercial and professional liability cases. Judge Alper now serves as a Neutral with The McCammon Group.

Hon. James C. Clark (Ret.)

Alexandria Circuit Court

The Honorable James C. Clark recently retired after over a decade of distinguished service on the 18th Judicial Circuit Court of Virginia (City of Alexandria). Before his tenure on the bench, Judge Clark enjoyed a successful career as a lawyer in private practice and served as the Assistant Commonwealth’s Attorney for the City of Alexandria. Among his many credentials, he served on the Alexandria Bar Foundation, the Substance Abuse Advisory Committee to the Alexandria City Council, and as a Mentor Judge for the Supreme Court of Virginia. Judge Clark is an Adjunct Professor at George Mason University and a former faculty member of the Virginia State Bar’s Harry L. Carrico Professionalism Course for new lawyers. Judge Clark now serves as a Neutral with The McCammon Group.
